The black-and-white-red flag of the Empire is regarded as a sign of recognition of the extreme Right, and the Kingdom’s citizens and is also pivoted fond of opponents of the corona measures. The Federal government now wants to proceed against the Show of Imperial flags and Imperial war flag of the Imperial period, but to a statutory provision in the criminal law.

A so-called Pattern for the police and the authorities aim of leading as an extension of criminal offences, be it according to the “daily mirror on Sunday” in a joint Letter to the Federal Ministry of the interior (BMI) and the Ministry of justice (BMJ), the German-Israeli Association of lawyers.

Their CEO Elmar Esser had flags in January, in a letter to interior Minister Horst Seehofer, “urge for a statutory prohibition of the provocative showing of Empire, Imperial war flags and similar symbols” advertised. The flags were for “xenophobia, anti-Semitism and democracy in contempt,” wrote the Cologne lawyer. “They are enemies of the free democratic basic order under conscious exploitation of a legal loophole for their anti-constitutional goals.”

Cat-and-mouse game between the legislator and the extremists feared

BMI-state Secretary Hans-Georg Engelke, and BMJ-Secretary of state Margaretha Sudhof reported to be in February. In the letter to eater, according to the “daily mirror”: It had to be noted, “it should not come to a shameful game of cat-and-mouse game between the legislator and the extremists, who could always make a new – yet actually a neutral or even a positive symbols and flags of its own.”

The Federal government and the Länder should communicate better to a consistent practice, and with the help of the right of Assembly, the Show, the controversial symbols stop. So could there be demonstrations of appropriate constraints in a way which explicitly prohibit the Showing of the Reich flags. Violations would be punished as an administrative offence, writes of the “daily mirror”. A law, however, would respect a ban, miss, would be a criminal case due. Elmar Esser was disappointed about the answer.

In December, the Federal state of Bremen had campaigned against the then-upcoming conference of interior Ministers for a single course against the Showing of the Reich war flag in Public. After the Bremen police was a law in September to a corresponding decree is supplemented, the NPD in Bremerhaven, Germany, is a rich war flags-Demo logged in with the Motto: “No ban, Black-and-White-Red”.

The case was brought before the Bremen administrative court and the Supreme administrative court. The judge came to the conclusion that the flags of the Show was “not without the Addition of other circumstances liable to prosecution”. Thus, the ban was overturned in the last instance – but the higher administrative court imposed requirements for the planned Demonstration. Instead of an hours-long March through the whole of the Hanseatic city, the protesters should be allowed to gather only three hours on the Domshof. In addition, the court limited the number of participants to 100. The organizers said the demonstration is ultimately the self.
